This Privacy Policy offers you information on how our service FairSavings (FairSavings is the product of admitad GmbH, Heinz-Nixdorf-Strasse 6, 74172 Neckarsulm, Germany, and is referred to in the following text as “FairSavings”, “we/us/our”) deal with your personal and non-personal data whether you visit our websites, located at whitelabel.admitad.com, wlcoupons.com, fairsavings.com, and coupon webpages on the third party websites.

2. Definitions

Technical data” means any information that cannot be related to your identity, like e.g. information on browser types, operating systems, domain names, access dates and times, referring website addresses, online transactions and browsing and search activity.

“Processing” means any operation or set of operations which is performed on data such as collection, recording, organizing, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.

The scope of how we collect and process personal and non-personal data on you or other information depends on the way you get in touch with us or our technologies and services:

  • as a visitor of whitelabel.admitad.com, wlcoupons.com, fairsavings.com;
  • as a visitor of coupon webpages on customer websites (third party websites);
  • as a coupon user of coupon webpages;

With this Privacy Policy, we want to keep you informed of which information we receive and use on every stage.

We use personal data only for administering and providing our technologies and services. We store personal and any other kind of data strictly in compliance with applicable data protection and privacy legislation and our contractual duties, and will prevent unauthorized access to data to the best of our abilities.

4. Collecting and processing of website visitors personal data.

If you visit the whitelabel.admitad.com, wlcoupons.com, fairsavings.com websites, we log the following data to facilitate the use of our website and to ensure its security and stability of our web servers:

  • the IP address of the requesting device;
  • the date and time of your visit;
  • the data specifications of your browser and operating system;
  • the website you were referred from to our website (so-called Referer URL).

This information is stored in a log file until it is automatically deleted.

To provide advice, support, answer any questions you may have.

Your data after filling out the form can be processed in mailing systems in accordance with paragraph 6.

5. Collecting and processing of coupon webpages’ visitors.

5.1) This article describes how personal information is collected, used, and shared when you visit coupon webpages on third party websites.

As part of the provision of coupon services for you, we may host our coupon webpages on third
party websites.

We are not responsible for and have no control over the processing of your data when you are visiting other web pages on third party websites. If you have any questions about how your data processes in a third party website, please read the privacy policy of the third party website.

How we process your data on coupon webpages is described below.

We log the following data to facilitate the use of our webpages on third party websites and to
ensure web-pages security and stability:

5.2.) This article describes how personal information is collected, used, and shared if you are the coupon user of coupon web pages;

Advertisers, affiliate networks and other third parties can place cookies onto your computer when you visit their website while using a coupon.

The cookies placed by advertisers, affiliate networks and other third parties are used to keep track your target action on the advertiser website to allow them to deliver the coupon services they are providing.

The advertiser’s website may also collect additional information about you related to the terms of use of the coupon.

Newsletters

We send out newsletters, e-mails and other electronic notifications with promotional information (hereinafter “Newsletter”) subject to the consent of the recipient or a legal permission.

The newsletters and business communication can be sent by FairSavings itself via corporate Gmail account.

We base the processing of your data on the following legal bases:

  • Your consent, if you have given us such consent (Art. 6 para. 1 lit. a) GDPR)
  • The initiation or execution of a contract with you (Art. 6 para. 1 lit. b) GDPR)
  • The fulfillment of legal obligations (Art. 6 para. 1 lit. c) GDPR)
  • The implementation of our legitimate interests (Art. 6 para. 1 lit. f) GDPR)

8. Data protection and transmitting to third parties

We take all technical and organizational security measures required to protect your personal data from loss, unauthorized disclosure or other forms of misuse. Data is stored in a safe environment that is not open to public access. Your personal data may be encrypted before transmission in certain cases (e.g. processing your login data). This means that – support by your browser provided – communication between your device and our servers will include recognized encryption measures.

Our staff has been trained in privacy matters and in dealing with data and information, which they gain access to in a responsible manner.

Please be aware that should you contact us via email, confidentiality of information therein may not be ensured. Third persons may have access to the contents of emails.

In order for us to execute its business processes in a convenient and optimal manner, it may be necessary for certain data to be processed by trusted 3rd parties and reliable partners. These 3rd parties may

  • process payments
  • fulfill orders
  • send email
  • manage communication (e.g. newsletters, security notifications, chat)
  • website hosting
  • conduct other related activities

on behalf of us. However, we only share such information needed to serve the specific purpose for which the 3rd parties were engaged. We ensure that these 3rd parties are under similar obligations to maintain privacy and confidentiality as our own employees are and that they will handle your information in the way and to the extent as we ourselves are permitted to. We do not allow any 3rd party to use your information for any purposes for which the information was not collected.

We will only disclose your PII abroad, if it is necessary for the intended purpose of processing. However, as a member of the worldwide Admitad group of companies, every local Admitad entity may maintain or perform data processing operations in countries outside the EEA or in countries without an adequate level of data protection, if it is required for the fulfillment of our obligations or the underlying agreement with you. Furthermore, subcontractors of Admitad which Admitad engages to act on its behalf in respect to the processing of your PII may be domiciled in such areas.

In order to secure such transfer and processing in accordance to chapter 5 of the GDPR, Admitad has implemented and requests the required technical and organizational measures as well as has entered into the appropriate contractual frameworks with group companies and subcontractors which make sure that the recipient of data has implemented an adequate level of data privacy in its organization as required by the GDPR. This includes signature of Data Processing Agreements as well as EU standard contractual clauses issued by the EU commission. These precautions are appropriate safeguards as requested by Article 46 GDPR and local data protection laws in effect, which make sure that your information will be treated securely, confidentially and in accordance with the applicable data protection laws.

In the event that FairSavings is acquired by or merged with a third party, we reserve the right, in any of these circumstances, to transfer or assign the information we have collected from you as part of such merger, acquisition, sale, or other change of control. In the unlikely event of our bankruptcy, insolvency, reorganization, receivership, or assignment for the benefit of creditors, or the application of laws or equitable principles affecting creditors’ rights generally, we may not be able to control how your information is treated, transferred, or used.

9. Transfer to Third Countries

Data is being transferred to countries outside the European Economic Area. We only transfer personal data to third countries where the EU Commission has confirmed an adequate level of protection or where we can ensure the careful handling of personal data by means of contractual agreements or other suitable guarantees, such as certifications or proven compliance with international security standards.

You have the following rights concerning our processing of your personal data:

  • Right to access;
  • Right to rectification;
  • Right to erasure;
  • Right to the restriction of processing;
  • Right to data portability;
  • Right to object (on grounds relating your particular situation) in case of processing of your personal data based on our legitimate interest;
  • Right to withdraw your consent at any time in case of any consent-based processing of your personal data, without affecting the lawfulness of processing based on consent before your withdrawal;
  • Right to lodge a complaint with a supervisory authority.

In case you registered as a publisher or an advertiser on our website, you may access your account and correct or delete some of your data by yourself.

While observing applicable privacy legislation, we will erase your data without any action required by you, if retention of your data is no longer necessary for the purpose pursued or retention is no longer allowed for any legal reason. We may restrict processing instead of erasing your data where legally not allowed to erase (e.g. legal obligations to maintain your personal data).

11. Amendments

We may modify this Privacy Policy and our data security provisions at any time, in particular, if new laws and regulations need to be adopted, or we regard amendments reasonable.
